TRAI's Recommendations on FM Radio Broadcasting Issues

Telecom Regulatory Authority of India (TRAI) has unveiled its recommendations regarding “Issues related to FM Radio Broadcasting.” The Ministry of Information and Broadcasting (MIB) sought the Authority’s guidance on specific matters, and TRAI has responded with insights and solutions to address these concerns effectively.

Introduction to TRAI’s Recommendations

In response to MIB’s request dated 11th May 2022, TRAI, in accordance with the TRAI Act, 1997, has put forth recommendations that aim to reshape the landscape of FM Radio Broadcasting in India. Two significant issues have been addressed:

1. De-linkage from Non-Refundable One Time Entry Fee (NOTEF)

TRAI recommends the removal of the linkage to the Non-Refundable One Time Entry Fee (NOTEF) in the formula for annual fees, as outlined in the FM Ph-III Policy Guidelines of 25th July 2011.

2. Extension of FM License Period

TRAI proposes an extension of the existing FM license period of 15 years by an additional 3 years.

Stakeholder Engagement

To gain valuable insights into FM Radio broadcasting challenges and opportunities, TRAI engaged with representatives of the Association of Radio Operators for India (AROI) on 5th August 2022. During this discussion, AROI representatives raised two key issues:

a. Private FM Radio Channels Broadcasting Independent News Bulletins

TRAI was urged to consider permitting private FM Radio channels to broadcast independent news bulletins, a move that could diversify media offerings.

b. Availability of FM Radio Receivers in Mobile Handsets

The availability of FM Radio receivers in mobile handsets was discussed, emphasizing the need for continued access to FM Radio features.

Consultation Process and Feedback

In response to these concerns, TRAI initiated a consultation paper on 9th February 2023, inviting stakeholders to provide their feedback on FM Radio Broadcasting-related issues. This inclusive approach sought to gather diverse perspectives. The submission deadline for comments was 9th March 2023, followed by counter-comments until 23rd March 2023. TRAI received substantial input, with 11 comments and 9 counter-comments from stakeholders. These valuable contributions are accessible on TRAI’s website.

Recommendations and Key Highlights

Following a comprehensive analysis of stakeholder feedback, TRAI has formulated a set of recommendations to address the issues at hand. Here are the salient features:

a. License Fee Structure

TRAI proposes that the annual license fee for FM radio channels be calculated as 4% of Gross Revenue (GR) during the respective financial year, with GST excluded from Gross Revenue (GR).

b. Relief Measures

In light of the challenges posed by the COVID-19 pandemic, TRAI suggests that the government takes appropriate measures to support FM radio operators.

c. Broadcasting News

Private FM Radio Operators may be permitted to broadcast news and current affairs programs, limited to 10 minutes in each clock hour, aligning with industry standards.

d. Program Code of Conduct

TRAI suggests that the program code of conduct applicable to All India Radio for news content may also be extended to Private FM Radio channels.

e. Enabling FM Radio Functionality

FM radio features should remain enabled and activated on all mobile handsets equipped with the necessary hardware. Built-in FM radio receivers must not be subject to any form of disablement or deactivation.

f. Oversight Committee

To ensure compliance by mobile phone manufacturers or importers, a Standing Committee, led by a senior officer of Joint Secretary or above level, may be established by the Ministry of Electronics and Information Technology (MeitY). The committee should include key stakeholders such as MIB, AROI, MAIT, and ICEA.

g. Online Grievance Redressal Portal

An online grievance redressal portal should be established to facilitate the submission of information or complaints regarding non-compliance with enabling FM radio functionality in mobile handsets with the necessary capabilities.
